Welcome to Spare.co.ke (the "Platform"). Please read these Terms and Conditions ("Terms") carefully before using our website or making any purchases. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

To use the Spare.co.ke Platform and place orders, you must be at least 18 years old, or have the consent and supervision of a parent or guardian.

You are responsible for maintaining the confidentiality of your account details, including your password, and for all activities that occur under your account. You agree to notify Spare.co.ke immediately of any unauthorized use of your account.

You agree that you will not use the Platform for any unlawful purpose or engage in any activities that:

• Attempt to gain unauthorized access to any part of the Platform, other accounts, or computer systems.

• Upload, post, or transmit any malicious software, viruses, or other harmful code designed to disrupt, destroy, or limit the functionality of any computer software or hardware.

• Collect or harvest personal information from other users without their consent.

Spare.co.ke grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform solely for the purpose of shopping for and purchasing products available for sale on the site.

All orders placed on the Platform are subject to acceptance by Spare.co.ke. We reserve the right to accept or reject any order, or to cancel an order after acceptance, for reasons including, but not limited to, product unavailability, errors in pricing or product description, or issues with payment verification. We will contact you if any portion of your order is cancelled or if additional information is required to accept your order.

• All prices displayed on Spare.co.ke are in Kenyan Shillings (KSh).

• Unless otherwise stated, prices are inclusive of applicable taxes (e.g., VAT).

• Payment must be completed in full through the methods provided at checkout (e.g., M-Pesa, card payment, etc.). We are not responsible for delays or non-delivery caused by failed or incomplete payments.

• Order Cancellation: Requests to cancel an order must be made before the item is shipped. Please refer to our separate Cancellation Policy for specific timelines and conditions.

• Refunds and Returns: All refunds and returns are processed strictly as per our dedicated Refund and Return Policy, which is available on the Platform.

• Coupons are promotional codes that customers can apply during checkout to receive specified discounts on their purchases.

• Coupons are subject to their respective terms and conditions, including expiration dates, minimum purchase requirements, and eligibility for specific products.

• Unless explicitly stated otherwise, coupons cannot be combined with other coupons or existing offers.

• Offers are special promotions (such as bundled deals, free gifts, or automatic percentage discounts) that provide discounts or benefits automatically, often without requiring customers to input a code.

• Offers are applied to specified products or categories and are visible on the product page, cart, or at checkout.

To the fullest extent permitted by law, Spare.co.ke, its directors, employees, or agents, shall not be liable for any indirect, incidental, punitive, special, or consequential damages (including, without limitation, damages for loss of profits, data, or business interruption) arising from the use or inability to use the Platform or the products purchased. Our total liability to you for any damages arising out of or related to your use of the Platform or any product is limited to the total amount you paid for the product(s) in question in the past twelve (12) months.

You agree to indemnify, defend, and hold harmless Spare.co.ke and its affiliates, directors, officers, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third-party.

Your privacy is important to us. Please refer to our separate Privacy Policy for detailed information on how we collect, use, and protect your personal data. By using the Platform, you acknowledge that you have read and agree to the Privacy Policy.

These Terms and Conditions are governed by and construed in accordance with the laws of Kenya, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
